BULLITT BARS TERMS AND CONDITIONS

These Terms and Conditions apply when you use the BULLITT Bars website or buy products from us. Please read them carefully before placing an order.

Nothing in these terms affects your statutory rights as a consumer.

1. WHO WE ARE

The BULLITT Bars website and online store are operated by Coldharbour Foods Limited, trading as BULLITT Bars ("BULLITT", "we", "us" or "our").

Our online store is hosted by Shopify. When you buy from this website, your contract is with Coldharbour Foods Limited, not Shopify.

2. USING OUR WEBSITE

You may use our website only for lawful purposes. You must not misuse the website, introduce malicious code, attempt to gain unauthorised access, interfere with its operation, or use it in a way that infringes another person's rights.

If you create an account, you are responsible for keeping your login details confidential and for providing information that is accurate and up to date. Please tell us promptly if you believe your account has been used without permission.

You must be at least 18 years old to place an order, or have permission from a parent or legal guardian who is responsible for the order.

3. OUR PRODUCTS AND FOOD INFORMATION

We take reasonable care to describe and display our products accurately. Product colours and appearance may vary slightly because of photography, packaging changes and the device or screen you use.

Ingredients, recipes, nutritional information, allergen information and packaging may change from time to time. Please read the current product information and all instructions and warnings on the packaging before consuming a product, particularly if you have an allergy, intolerance, medical condition or sensitivity.

Some BULLITT products contain caffeine. Please follow the caffeine information and any warnings shown on the product page and packaging. Our products and website content are not medical advice.

If information on the website appears to differ from the packaging, or if you are unsure whether a product is suitable for you, please contact us before consuming it.

Products are subject to availability. We may change or discontinue a product, or limit the quantity that may be ordered, where reasonably necessary.

4. ORDERS AND FORMATION OF THE CONTRACT

When you submit an order, you are offering to buy the products in your basket. An automated order acknowledgement confirms that we have received your order but does not mean that we have accepted it.

The contract between you and us is formed when we send you confirmation that your order has been dispatched, unless we expressly confirm acceptance at an earlier time.

We may decline or cancel an order before dispatch if, for example:

- a product is unavailable;
- there is an obvious pricing or product-description error;
- your payment cannot be authorised;
- we reasonably suspect fraud or misuse; or
- we cannot deliver to the address provided.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled products and any related delivery charge.

Please check your order and delivery details carefully before submitting them. Contact us as soon as possible if you need to make a change. We cannot guarantee that a change or cancellation can be made once an order is being prepared or has been dispatched, but your legal cancellation and return rights are not affected.

5. PRICES AND PAYMENT

Prices are shown in pounds sterling and include applicable UK taxes unless stated otherwise. Delivery charges and any other charges will be shown before you place your order.

The price you pay will normally be the price shown at checkout. If we discover an obvious pricing error, we will contact you and give you the option to continue at the correct price or cancel the order for a full refund.

You must use a payment method that you are authorised to use. Payment is processed through the payment services offered at checkout. We do not receive or store your full card details.

6. DELIVERY

We deliver to the locations available at checkout. Available delivery methods, charges and estimated delivery times will be shown before you place your order.

Delivery dates and times are estimates unless we expressly agree a guaranteed date with you. We will deliver without undue delay and, unless a different period has been agreed, no later than 30 days after the contract is formed.

If delivery is delayed by an event outside our reasonable control, we will contact you as soon as reasonably possible and take steps to minimise the delay. Your legal rights relating to late delivery remain unaffected.

The products remain at our risk until they are delivered into your physical possession, or to a person you identify to receive them. Please contact us promptly if a parcel is lost, damaged or appears to have been tampered with.

7. CANCELLATIONS, RETURNS AND REFUNDS

Your statutory rights apply in addition to this section and our Refund Policy, which is available in the website footer.

Changing your mind

For most online purchases, you have the right to cancel within 14 days after the day on which you receive the goods. If an order is delivered in separate instalments, the period normally begins after you receive the final instalment.

To cancel, email hello@bullittbars.com with your name, order number and a clear statement that you wish to cancel. You then have a further 14 days to return the products. We will provide return instructions and the appropriate return address.

Unless the products are faulty, damaged, not as described or we agree otherwise, you are responsible for the direct cost of returning them. You must take reasonable care of the products. We may make a lawful deduction from the refund if the value has been reduced by handling beyond what is necessary to establish their nature, characteristics and functioning.

We will refund sums due without undue delay and no later than 14 days after we receive the returned goods or, if earlier, 14 days after you provide evidence that you sent them back. We will use the original payment method unless agreed otherwise. Where required by law, we will also refund the cost of our least expensive standard delivery option.

Exceptions

The right to change your mind does not apply where a legal exception applies. This may include goods that are liable to deteriorate or expire rapidly, and sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed. We will not rely on an exception unless it applies to the particular product and circumstances.

Faulty, damaged or incorrect products

Products must be of satisfactory quality, fit for purpose and as described. If a product is faulty, damaged, unsafe, not as described or supplied incorrectly, contact us as soon as possible. We will deal with the matter in accordance with your rights under the Consumer Rights Act 2015, including a repair, replacement or refund where appropriate.

Please keep the product and its packaging until we have advised you what to do, and provide photographs where reasonably requested. We will cover reasonable return costs where the product is faulty, damaged or incorrect.

8. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may have additional terms, including dates, eligible products and usage limits. Unless stated otherwise, codes cannot be combined, exchanged for cash or applied after an order has been placed.

We may withdraw or correct a promotion where there is an error, fraud, misuse or another reasonable basis for doing so. This will not affect an order we have already accepted unless required by law or agreed with you.

9. INTELLECTUAL PROPERTY

The content on this website, including the BULLITT name and branding, text, photographs, graphics, videos, designs and other materials, is owned by or licensed to us and is protected by intellectual-property law.

You may view the website and make copies reasonably necessary for personal, non-commercial use. You must not reproduce, distribute, modify, publish, sell or commercially exploit our content without our written permission, except where the law permits it.

10. REVIEWS AND CONTENT YOU SUBMIT

If you submit a review, photograph, suggestion or other content, you confirm that it is accurate, lawful, your own work or that you have permission to use it, and that it does not infringe another person's rights.

You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting BULLITT Bars. You retain ownership of your content. We may remove content that is unlawful, misleading, offensive or infringes another person's rights.

11. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to services operated by third parties, including Shopify, payment providers, delivery companies and social-media platforms. Their own terms and privacy notices may apply when you use their services.

We are not responsible for the content or operation of an independent third-party website. This does not limit any responsibility we have for the products you buy from us or any liability that cannot lawfully be excluded.

12. PRIVACY AND COOKIES

Our Privacy Policy and Cookie Policy explain how personal information and cookies are handled. They are available from the website footer. Shopify and other service providers may also process information as described in those policies.

13. OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. A loss is foreseeable if it was obvious that it would happen or if both you and we knew it might happen when the contract was formed.

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, and your statutory consumer rights.

We supply products for private and domestic use. If you use them for a commercial or business purpose, we are not responsible for loss of profit, loss of business, business interruption or loss of business opportunity, except where the law does not allow that liability to be excluded.

14. SUSPENSION OR TERMINATION OF WEBSITE ACCESS

We may suspend or restrict access to the website where reasonably necessary for security, maintenance, suspected misuse or a breach of these terms. This does not affect a contract for an order we have already accepted or your statutory rights.

15. CHANGES TO THESE TERMS

We may update these terms from time to time, for example to reflect changes to our products, services, technology or the law. The latest version will be posted on this page with the date it was updated.

The terms that apply to an order are those in force when the contract for that order is formed. A later change will not alter an existing contract unless the change is required by law or you agree to it.

16. GOVERNING LAW AND DISPUTES

Please contact us first if you have a complaint so that we can try to resolve it.

These terms and any contract between you and us are governed by the law of England and Wales. If you live in England or Wales, the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts and you retain any mandatory protections provided by the law where you live.

17. GENERAL

If any part of these terms is found to be unlawful or unenforceable, the remaining parts will continue in effect.

If we do not enforce a right immediately, that does not mean we have waived it.

No person other than you and us has a right to enforce the contract between us, except where the law expressly provides otherwise.
